Terms of service
Last updated
These terms are an agreement between you and Intake Pay Inc., a corporation based in Ontario, Canada, which runs IntakePay (“the service”, “we”, “us”). They are written to be read. By creating an account you agree to them. If you do not agree, do not use the service. Questions go to support@intakepay.com.
1. The service
IntakePay lets a freelancer (“you”) create a client record, send that client a unique link, and have the client answer your intake questions and pay a deposit by card. Deposits are processed by Stripe on your own Stripe account. You see each client’s status and answers in your dashboard, and we email you when a client pays.
IntakePay is deliberately narrow. It does not provide a contract builder or signing envelopes (only your own terms, which your client signs by typing their name before paying), scheduling (only your own booking page after payment, shown inside the confirmation page when it is on Calendly), client documents (only up to three photos, when your form asks for them), project management, a client portal, team accounts, a refund interface or integrations beyond its MCP server. The full list is on the What we won’t do page.
2. Who can use it
- You must be at least 18 years old and able to enter a binding agreement.
- You must use the service for your own business, as a sole practitioner or the owner of a small business, not as a consumer.
- You need a Stripe account that can accept card payments, based in one of the 43 countries IntakePay works with (the US, Canada, the UK, every EU country, Australia, New Zealand, Japan and Singapore, among others; the setup page lists them all), created or connected through Stripe’s own pages, before your links can take deposits. Deposits are charged in US dollars, wherever your Stripe account is. Your clients can pay by card from anywhere.
- You must give accurate account information and keep your email address current.
- You must not be located in a country, or be a person, that the sanctions laws of Canada, the United States, the European Union or the United Kingdom bar us or Stripe from serving.
3. Your account
You sign in with a link or a one-time code sent to your email address, so access to that inbox is access to your account. Keep it secure. You are responsible for activity on your account and must tell us at support@intakepay.com if you believe someone else has used it.
4. Subscription and billing
- IntakePay costs $19 per month (USD), and it is free until the first time a client pays you through IntakePay. There is one plan and no free tier. Prices do not include taxes; where we are required to charge a sales tax, VAT or GST, it is added at checkout.
- A card is required to start. Nothing is charged until a client first pays you through IntakePay. That day your plan starts: your card is charged $19, then every month after that, and the email telling you about that payment says so. If no client ever pays you through IntakePay, you are never charged. Accounts that started on a 14-day free trial keep it: the card is charged when that trial ends.
- Billing is handled by Stripe. Card details are entered on Stripe’s pages and never reach our servers.
- You can cancel anytime from the Stripe billing portal linked on your billing page. Cancellation takes effect at the end of the current billing period, and you keep access until then.
- We do not refund partial months, unless the law requires it.
- If a renewal payment fails, Stripe retries the card and you keep full access for 3 days while you update it. After that, the dashboard is limited to the billing page until the subscription is paid. Client links you have already sent stay payable throughout.
- If we change the price, we will email you before the new price applies to your next billing period, so you can cancel first if you choose.
5. Payments between you and your clients
- Every deposit is a direct charge on your own Stripe account. The money goes from your client to you through Stripe. IntakePay never holds, receives or transfers those funds.
- IntakePay takes no fee or percentage of any deposit. Stripe charges its standard processing fees on your account, under your agreement with Stripe.
- Deposits are charged in US dollars. If your Stripe account pays out in another currency, Stripe converts the money when it pays you, at its rates and with its conversion fee.
- IntakePay is not a party to the agreement between you and your client. You decide what you sell, the deposit amount (from $1 to $50,000 per link) and your refund and cancellation terms, and you are responsible for delivering what you sell and for any taxes on it.
- Your terms are yours. IntakePay shows them to your client as you wrote them and records the name your client types to sign them, the time, and the exact text, next to the payment. We don’t review your terms, and we don’t promise that a typed name is a valid signature for them where you or your client are: if it matters, ask your lawyer.
- Refunds and disputes are handled by you in your Stripe Dashboard. When a deposit is fully refunded or disputed, the client’s status in IntakePay updates to show it.
- Your use of Stripe is governed by your own agreement with Stripe (the Stripe Services Agreement). Stripe may decline, hold or reverse payments under that agreement.
- A client is shown as Paid only after Stripe confirms the payment to us. If a confirmation is delayed or fails, your Stripe Dashboard is the authoritative record.
6. Your content and your clients’ information
You keep ownership of everything you put into IntakePay: your business details, logo, questions, and the client information and answers collected through your links. You give us permission to store, process and display that content only as needed to run the service for you.
You decide what to ask your clients, so you are responsible for having a lawful reason to collect their answers and for telling them how you use them. We process your clients’ information on your behalf, as described in our privacy policy. We never email your clients.
7. Data processing terms
When you collect information from your clients through IntakePay, you decide what is collected and why, and we process it for you. Where data protection law (such as the GDPR or the UK GDPR) calls you the controller and us your processor, this section is our data processing agreement. It applies for as long as we process your clients’ information.
- We process your clients’ information only to provide the service, as these terms and your use of it direct (your instructions), unless the law requires otherwise; if it does, we will tell you first where the law allows.
- Everyone at IntakePay who can access it is bound to keep it confidential.
- We protect it with the measures in the Security section of our privacy policy, and keep them up to date.
- The service providers in the privacy policy’s list help us process it, under written terms that protect it at least as well as these. We will update that list and email you before adding a provider; if you object, you can end your account.
- We help you answer your clients’ requests to see, correct or delete their information (you can also do it yourself: deleting a client deletes their answers), and give you the information you reasonably need for a data protection impact assessment or a regulator’s questions.
- If we become aware of a breach affecting your clients’ information, we will tell you without undue delay, with what we know and what we are doing about it.
- When your account is deleted, we delete your clients’ information as the privacy policy describes, except what the law requires us to keep. You can export it as a CSV first.
- We make available the information needed to show we meet these obligations, and answer reasonable questions about them in writing.
- Transfers out of the European Economic Area, the UK or Switzerland rely on the safeguards described in the privacy policy (Where your information is stored).
8. Acceptable use
You agree not to use IntakePay to:
- Collect health or medical information, including diagnoses, conditions, medications, treatment, therapy, disability or mental-health details. The service is not designed to hold it. The one exception: a food business may ask which food allergies or dietary needs to keep out of an order, and nothing more about the person’s health.
- Collect government ID numbers, bank or card details, or passwords through intake questions, or ask for photos of people’s IDs or documents.
- Sell anything that Stripe’s restricted or prohibited business list does not allow, or anything illegal.
- Send links to people who have not asked to work with you, or send spam.
- Mislead clients about who you are, what they are paying for or where their money goes.
- Probe, overload or attempt to bypass the security of the service, access another account’s data, or reuse the service to build a competing product.
We may remove content or suspend an account that breaks these rules.
9. API keys and the MCP server
You can create an API key to use IntakePay from an AI assistant that supports the Model Context Protocol. The key is shown once and stored only as a hash. Treat it like a password: anyone with it can create client links and read your clients’ answers. You are responsible for actions taken with your key and for the assistant you connect it to, including what that assistant does with the information it receives. Revoke a key from Settings at any time. API use is rate-limited and requires an active subscription.
10. Availability and changes
We work to keep IntakePay available and your data safe, but the service is provided “as is” and “as available”. It depends on third parties, including Stripe, and may be interrupted for maintenance or by events outside our control. We may change or remove features. If a change materially reduces what your subscription includes, we will tell you in advance by email.
11. Disclaimers and limitation of liability
To the extent the law allows, we disclaim all warranties not stated in these terms, including fitness for a particular purpose. We are not liable for indirect, incidental, special or consequential losses, or for lost profits, revenue or data. Our total liability for any claim relating to the service is limited to the amount you paid IntakePay in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.
12. Claims about your business
You will cover our losses, and reasonable costs including legal fees, from claims brought by your clients or anyone else about what you sell, your dealings with your clients, the content and questions you put into IntakePay, or your breach of these terms or the law. We will tell you about such a claim promptly and let you take part in handling it.
13. Ending your account
You can stop using IntakePay at any time by cancelling your subscription. To delete your account and its data, use Delete your account in Billing, or email support@intakepay.com from your account’s email address; the privacy policy describes exactly what is deleted and what is kept. Deleting your account deletes your client links, so clients can no longer pay through them.
We may suspend or close an account that breaks these terms, puts other users or clients at risk, or is required to be closed by law or by Stripe. Where we can, we will tell you first and give you time to export your data.
14. Changes to these terms
We may update these terms. The date at the top shows the latest version. If a change materially affects you, we will email you before it takes effect. Continuing to use the service after that means you accept the updated terms.
15. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have jurisdiction over any dispute about them, unless the law where you live gives you the right to bring a claim in your own courts.
16. General
- These terms and the privacy policy are the whole agreement between you and us about IntakePay.
- If part of these terms can’t be enforced, the rest still applies.
- If we don’t enforce a right straight away, we haven’t given it up.
- You may not transfer your account or these terms to someone else without our agreement. We may transfer them to a company that takes over IntakePay, and we will tell you if we do.
- Neither of us is responsible for delays or failures caused by events outside our reasonable control.
- We send notices to the email address on your account; send yours to support@intakepay.com.
- These terms are written in English. If we ever provide a translation, the English version applies.
